I Was Charged With Reckless Driving in Allegan County — Now What? 57th District Court - Judge Skocelas -Burnett

2/13/2026

If you were charged with Reckless Driving in Allegan County, your stomach probably dropped the moment you saw the word misdemeanor.

Reckless driving is not “just a ticket.”

It is a 93-day criminal misdemeanor in Michigan.

That means:
  • A criminal record if convicted
  • Six points on your license
  • Possible license suspension
  • Significant fines and costs

Take a breath.

This is serious — but it is manageable with the right strategy and mindset.

What the Prosecutor Has to ProveTo convict you of reckless driving, the prosecution must prove:
  1. You drove on a public roadway or place generally accessible to vehicles (including parking lots), and
  2. You operated your vehicle in willful or wanton disregard for the safety of persons or property.

“Willful or wanton disregard” is more than simple carelessness.

It does not require intent to cause harm — but it does require knowingly disregarding obvious risks.

That mental state is the battleground.

What Does That Look Like in Real Life?

The prosecution will usually rely on:
  • Officer testimony
  • Speed allegations
  • Road and weather conditions
  • Accident reports
  • In some cases, alleged alcohol involvement

But here’s the key:
  • Not every accident. Not every lane change.
  • Not every speeding allegation equals recklessness.
  • Sometimes it’s a blind spot.
  • Sometimes it’s a split-second judgment call.
  • Sometimes it’s negligence — not willful disregard.
  • That distinction matters enormously.

Why These Cases Feel Bigger Than They Look

Many people think:

“It’s just traffic.”
It’s not.
Reckless driving carries many of the same consequences as a drunk driving offense in terms of license impact. And because it is a criminal misdemeanor, it creates a permanent record.

This is where mindset becomes critical.

If you approach the case as a victim — blaming the other driver, minimizing what happened, assuming you’re owed something — that rarely produces the best result.

From the judge’s perspective, reckless driving represents public safety risk.

And every judge has their own worst memory on the road — a near accident, a dangerous driver, a family member put at risk.

Human nature makes it difficult to give someone charged with reckless driving the benefit of the doubt automatically.

Bridging the Visibility GapA police report captures seconds.

Your life spans decades.

The challenge in reckless driving cases is what I call the visibility gap — the gap between the isolated moment on the road and who you actually are as a person.

If the court only sees:
  • The speed
  • The lane change
  • The accident

That becomes your identity in the file.

Our job is to bridge that gap.

To make sure the court sees:
  • Your full driving history
  • Your overall character
  • Your stability and responsibility
  • Whether this is a pattern — or an isolated lapse

Stakeholders vs. ShareholdersIn every case there are stakeholders:
  • The judge
  • The prosecutor
  • Probation
  • The public

If they see you as the problem, penalties reflect that.

But if we can turn them into shareholders — invested in your progress and accountability — the dynamic shifts.

That requires a proactive approach.

What’s in Your Wallet?Not financially.

But as a driver and citizen.
  • Do you have a clean record?
  • Years of responsible driving?
  • A stable career and life?
  • Evidence this was a one-time error in judgment?

Or is there a pattern?

Reckless driving cases are evaluated in context.

The question becomes:

Is this who you are — or is this a moment?

The Growth Mindset ApproachComplex change isn’t easy.

But reckless driving cases can become turning points.

Instead of minimizing:
  • Acknowledge seriousness.
  • Understand public safety concerns.
  • Demonstrate maturity.
  • Create measurable progress now — not promises later.

Time matters. Action taken today carries more weight than intentions expressed months from now.

When you build assets on your case — documented steps, thoughtful positioning, credible presentation — you begin reshaping the narrative.

You reset.
You rebrand.
You earn credibility.

So Now What?

If you’ve been charged with reckless driving in Allegan County:
  1. Do not treat this like a simple speeding ticket.
  2. Do not panic and assume the worst.
  3. Do not approach it defensively.

Instead:
  • Slow down.
  • Assess the facts.
  • Build a strategy.
  • Close the visibility gap.

You are more than the few moments described in a police report.

Handled correctly, this case can move from being a defining moment to being a refining moment.
Take a breath.

Let’s make sure the 57th District Court sees who you really are — not just what happened on that stretch of road.
